Contemporary financial applications of the Kharaj rule by guarantee.

Abstract

   The study aimed to demonstrate Contemporary financial applications of the Kharaj rule by guarantee. To achieve the objective of the study, the researcher followed the descriptive analytical and deductive approach.

   Therefore, the study is divided into three sections: First: addressing the definition of the abscess base with the guarantee, and the second: addressing the legalization of the base of the abscess with guarantee; and the third: taking samples of some contemporary applications on the base of the abscess with guarantee.

. The study reached several results, the most important of which is: The rule of abscess in guarantee enters into many of the modern financial transactions. These transactions include bank deposits, the Muntahia Bittamleek lease, the declining participation in Muntahia Bittamleek and the joint Mudaraba in terms of guaranteeing the funds therein.      The researcher also recommends further studies of this rule, especially its contemporary applications, especially with respect to the sale of peace, the sale of Istisna'a, the letter of guarantee, speculation and other contemporary transactions dealt with by Islamic banks.
