قاعدة كل ما لا ضابط له في الشرع ولا في اللغة يرجع فيه الى العرف وتطبيقاتها
Abstract
Summary
The rule (everything that has no control in Sharia or language is due to custom and its applications)
This study came to contribute to studies and research related to the rules of jurisprudence, as it dealt with this rule in detail in terms of clarifying the individual and overall meaning, its validity, the exceptions contained therein, and the related words. The last requirement was the applied aspect, in which three applications from the various sections of jurisprudence were mentioned.
The research concluded with results, the most important of which is that when there is no specification in the Sharia or in the language, we return to custom to control and define it, and that custom has its consideration among scholars in terms of specifying the general and restricting the absolute, and that it is a source of Islamic legislation.
