The Law Applicable in The International Employment Contract Under Qatari Law: A Comparative Study with The Jordanian Law

Abstract

The Qatari legislator organized the rules of private international law under Articles (38-10) of the Qatari Civil Law No. 22 of 2004, and due to the importance of contractual obligations, specifically the international employment contract, the Qatari legislator was keen to protect the rights of workers who considered as the foreign element in the labour contract concluded between countries. This study aims to clarify the law applicable to the international employment contract by following the analytical comparative approach between both the Qatari law and the Jordanian law.   

    The study reached several results, including: The rules of the international labour contract were an exception to the principle of will law. Accordingly, the Qatari legislator included his national laws with a special text that deals with the issue of the law applicable to the international employment contract, unlike the Jordanian legislator.
