Abstract

   The study dealt with the effect of the loss of money on the forfeiture of zakat, and explained in the first section the meaning of zakat, the conditions for its obligation, and the meaning of loss. It also showed in the second section a number of important issues to clarify the effect of the loss of money on the forfeit of zakat, which are: how zakat is obligatory, and the attachment of zakat to the property or the liability. The requirement of being able to pay zakat is obligatory, then I explained the ruling on the loss of money during the year and after it, and its effect on zakat.It concluded that zakat is only obligatory when all its conditions are met. In order to achieve justice with the owners of the money and those entitled to zakat, and among the wisdom of these conditions is to verify the wealth of the owner and his ability to provide comfort. It also concluded that zakat is immediately obligatory, and that it is related to the owner’s liability after one year has passed, and that being able to pay zakat is not one of the conditions for its obligation.Regarding the effect of the loss of zakat money: The study concluded that the loss of money during the year waives zakat on the value of the lost money, and may lead to the loss of the obligation of zakat entirely. As for the loss of money that occurs after the year: Zakat is waived if it occurs before one is able to pay, while zakat is not waived after one is able to pay. By analogy with prayer and other acts of worship that are not waived except by performing or making up for it, just as delaying performance when there is no impediment is negligence that leads to liability when damage occurs.The study followed the inductive and deductive approaches in collecting the study’s information, analyzing it, and presenting and deriving jurisprudential rulings through it.It recommended studying: the issue of the impact of the jurisprudential disagreement on the attachment of zakat to the property and the liability in zakat issues, its contemporary applications, and the issue of error in paying zakat.   Keywords: zakat, destruction, transfer, empowerment, immediate, slackness.
