Towards a legislative regulation to Insurance self-driving vehicles in Jordan

Abstract

     Due to the specificity of self-driving vehicles in terms of their use and their containment of software and algorithms that when driving them, at the fifth level in particular, lead to the absence of a human driver, these vehicles are vulnerable to accidents like other traditional driving vehicles, and they have been defined as vehicles that contain software and technological systems that enable them to be able to To make independent decisions on the road.

 

     Based on this, its use resulted in many problems that were an urgent reason for subjecting it to regulatory rules, starting from authorizing its use to subjecting it to compulsory insurance that is commensurate with its nature, noting the challenges related to insuring it due to its lack of a human driver, and then working to determine the liability resulting from the damages resulting when They commit accidents using smart systems. Hence, this study came to shed light on the most important proactive legal rules that the study reached, which is expected to be a basis for the legislator to be guided by them to build a legislative system that governs these vehicles in terms of insurance and determining the basis of civil liability.

      One of the most important results was represented by the most important legal challenges in determining the liability arising when an accident occurs due to the autonomous driving systems in the vehicle, and its consequences in determining the responsible party and compensation for the damage. And the inadequacy of the compulsory insurance system for traditional vehicles in Jordan, which is not compatible with accidents resulting from the operation of self-driving vehicles.

The researcher also made several recommendations, the most important of which was considering the liability arising from artificial intelligence systems as a responsibility of a special nature, given that intelligent autonomous systems have a special legal status in their ability to keep up with and simulate the human mind in terms of the ability to learn and make decisions independent of their operator, and the necessity of adding Self-driving vehicles are subject to the compulsory vehicle insurance system and are subject to compulsory insurance while allowing smart systems to be licensed in conjunction with their insurance.
