The Extent to which Artificial Intelligence can be Granted Legal Personality and A Statement of Civil Liability for Damages Caused by Artificial Intelligence Systems in Jordanian Legislation

Abstract

Artificial intelligence systems have evolved to the point of simulating human mental responses, and they have many benefits. However, artificial intelligence systems were not satisfied with their good side that was beneficial to humanity; As it caused injury to humans, it showed its harmful other side with many damages, and it also caused damage to property, and from here came the research into civil liability for the damages that artificial intelligence can cause, specifically with regard to the basis of that liability, and methods of paying it, and it was obligatory to be exposed in this The study aims to clarify the legal nature of these systems, while opening the door in the future to the possibility of recognizing a new electronic or digital legal personality, which in itself differs from the legal personality granted to a legal person.

The study also concluded that it is preferable to establish civil liability for damages caused by artificial intelligence systems and technologies based on the two theories: liability for things and liability for defective products, with a statement of the jurisprudential opinions supporting and opposing those two theories as a basis for civil liability.
