Abstract

ABSTRACT

Objectives This study dealt with the evidence of istihsan according to custom to highlight the impact of reasoning based on its evidence in contemporary reality. It aims to explain the truth of istihsan according to custom, explain the pillars of istihsan according to custom, explain the controls related to implementing istihsan according to custom, and explain the extent to which it has been verified in various modern issues.

Methods: In studying this topic, the researcher adopted the descriptive approach, which appeared through describing images of contemporary issues and demonstrating the extent to which the pillars and controls for implementing istihsan according to custom have been achieved in a number of modern issues. The incomplete inductive approach was adopted by tracking the sayings, meanings and contemporary issues that fall under the istihsan according to custom, where I collected the scientific material, then classified it according to the principles of scientific research.

Results: The study reached a number of results, the most prominent of which are an explanation of the truth about the approval of custom, and a statement of the pillars and controls for implementing this guide, the impact of which was demonstrated on a number of modern applications in our contemporary reality in various fields.

Conclusion: Highlighting the theoretical aspect in the contemporary applied aspect in a number of modern applications, including: (renting a church due to the inability to have mosques specifically for Muslims in infidel lands), (selling apartments and real estate off-plan), (dealing with certified checks in the sale of gold), and (endowing Bank deposits and receipt of their returns).
