Abstract

This study addresses an ancient and contemporary jurisprudential issue, in which the researcher elucidates the concept of “comprehensive partnership” according to the scholars of the four Sunni schools of Islamic jurisprudence. The study reveals the real disagreements and opinions of these jurists, along with the evidence presented by each school of thought. It also explores how modern forms of partnerships can be related back to the concept of “comprehensive partnership” as determined by the jurists.

Firstly, the study defines the linguistic concept of partnership, using an analytical approach to analyze the statements and a comparative approach to highlight their differences in understanding this concept, and subsequently identifies the areas of disagreement.

The researcher concludes that there are varying interpretations of “comprehensive partnership” among jurists, with some including multiple forms within it, some restricting it to a single form, and some taking a middle ground.

 The researcher suggests considering new forms of partnerships that align with the legal rulings established by the jurists, while also meeting the needs and developments of the contemporary era.
