Abstract

    The study aimed to establish the Islamic jurisprudential basis for notification and to clarify the applications of Sharia policy in the notification procedures in Sharia courts, ensuring that the procedures are carried out within the boundaries of Islamic law. This contributes to enhancing the credibility of the judicial process and increasing public trust in the judicial system. To achieve this, the researcher employed the inductive method, followed by the analytical and descriptive methods, to study the texts of the Sharia Procedures Law related to notification, its elements, and its types, revealing the aspects that demonstrate the objectives of Sharia achieved therein. The study was presented in a plan consisting of an introduction and two chapters. The study reached several conclusions, including that judicial notification has a Sharia-compliant characterization that fulfills the intended purposes of Sharia policy in the judiciary. The study concluded with a set of recommendations, most notably the move towards implementing green judiciary in Sharia courts as an initiative to improve the efficiency of the judicial system and preserve the environment, and the preparation of a comprehensive plan for transitioning to digital judiciary enhanced with full protection by cybersecurity experts.
