Abstract

This research aims to clarify Shafi'i jurisprudential assumptions and their origins, as well as to define and highlight the importance of contemporary jurisprudence on new issues. It examines the impact of these assumptions on ruling contemporary issues by presenting practical examples of modern issues resolved through Shafi'i hypothetical cases. Key issues studied include gender transformation and its impact on legal branches, lunar sighting via telescope, performing the Sa’i ritual by plane, and transactions via phone. The study concludes that previously assumed jurisprudential scenarios are not merely academic luxuries but essential for thoroughly exploring and resolving new issues. Contemporary scholars benefit from these assumptions to address modern legal questions effectively.
