The jurisprudential differences in the guarantee mentioned in the book Al-Bahr Al-Ra’iq by Ibn Nujaym Al-Hanafi “Collection and Study”

Abstract

The study dealt with the jurisprudential differences in bail through the book Al-Bahr Al-Ra'iq, an explanation of Kanz Al-Daqa'iq by Ibn Nujaym Al-Hanafi; because the jurisprudential differences are of great importance in understanding jurisprudence by distinguishing between similar matters and clarifying the accuracy of jurists, and serving students of jurisprudence in general, and students of the Hanafi school in particular, as in this study. We followed the inductive, analytical, and deductive method in clarifying the jurisprudential differences in bail, and we reached many results, the most important of which are: Ibn Nujaym did not follow a single methodology in mentioning and clarifying the differences in bail, and he frequently quoted from others in it, and the multiple forms of differences and not being limited to the issues of bail, and the forms of similarity between them and the justifications for the differences varied based on that.
