This study aimed to explore the concept of foreign investment and its legal nature, examine the legal status of foreign investors, and identify the authority responsible for investment under Jordanian law. The researcher adopted the descriptive-analytical method and concluded that foreign investment encompasses the transfer of capital, including funds, intangible assets, and technical and managerial expertise, from one country to another through individuals or international entities to develop the economy of the host country, provided there is an attractive environment. Its impact extends beyond financial aspects to include the transfer of knowledge and technologies, The Jordanian legislator has not explicitly defined foreign investment, reflecting legislative flexibility intended to adapt to economic and political changes and simplify legal texts to expand investment opportunities and attract foreign capital. This approach fosters an open investment environment for various types of investments.
The researcher recommended that the Jordanian legislator explicitly include obligations on foreign investors related to environmental protection, safety, employee training, and the development of Jordanian human capabilities in the Investment Environment Law and related regulations. Such measures would contribute to technology transfer and the improvement of infrastructure.
