Appeal in the interest of the law in the Jordanian Sharia justice system

Abstract

This research deals with an important topic of the Sharia judiciary (appeal in the interest of the law). The research was divided into three sections and a conclusion containing the most important results and recommendations. Whereas appeal in the interest of the law is one of the important emerging judicial topics that can be a path to enable the Supreme Sharia Court to extend its control over judicial rulings that can be appealed by this method of appeal. This study dealt with the idea of ​​this appeal, its conditions, the appeal list, and the elements that it must include. It also revealed the judicial application of these texts and the path that must be followed to submit this type of appeal and the path of the Supreme Sharia Court in dealing with it.

Since this appeal is limited to a specific type of rulings that have their own conditions, and since the research based on the practical application of the provisions of the law related to this appeal has shown results in reality, the trend towards including the decisions issued by the head of execution and the decisions issued by the inheritance judge with the possibility of appeal in the interest of the law will have the same positive effect resulting from enabling the Supreme Court to extend its control over this type of rulings and decisions.
