سمات الأمر الوجوبي عند الأصوليين دراسة تحليلية

Abstract

This study aims to clarify the characteristics of the obligatory ordainment with the fundamentalists, by searching into what was said about them, or what they have mentioned in the fundamental sources of the  principles  Science of Islamic jurisprudence. The researchers focused on describing what traits mean to scholars of fundamentalists, they identify the most prominent features of the obligatory ordainment. Two main approaches were used by the researchers, the inductive approach and the descriptive-analytic approach.

 One of the most notable results of this study was that traits of obligatory ordainment mean adjectives that manifest the significance of unrestricted request that indicates obligation and distinguishing it from others, and the most likely idea with the great majority of jurists and logicians is that the unrestricted request indicates obligation. The study also identified a number of features that indicate absolute unrestricted request indicates obligation among the most prominent of them was the absence of the presumption that remote the obligation, the hearty will, and the matter relates to the pure right of Allah, having preliminaries that wish to do the commanded, and the fact that the matter is roomy relating to the existing not the nonexistent.
