Abstract

     The study clarified the linguistic and technical meaning of cause and wisdom, and the position of jurists regarding linking rulings to wisdom. It also clarified the cases in which rulings are linked to wisdom in its various types: apparent and regulated, devoid of a criterion, and regulated by a criterion. It also clarified a group of jurisprudential and contemporary applications. The study concluded that jurists link their rulings to apparent and regulated descriptions, and that the disagreement of jurists in interpreting the text led to their disagreement in determining the cause of the ruling. Some of them contradicted their origin and linked the ruling to unregulated wisdom due to the absence of a regulated cause, and some of them linked it to the regulated cause that they derived from the text. In rare cases, some of them linked rulings to unregulated wisdom due to the impossibility of the existence of a regulated cause.
