Abstract

The study was conducted to clarify both the general and specific components of the crime of electronic begging and the corresponding criminal liability under Jordan’s cybercrime law.

The study examined cases of begging carried out through electronic means and addressed by traditional legal provisions in Jordanian legislations, including panel code, the juvenile law, the juvenile behavior monitoring law, and anti-human trafficking law. The study also aimed to explore the context of legal deficiencies and the issue of overlapping criminalization of electronic begging between the cybercrime law and conventional legal status.

The findings of the study revealed several key points, in particular the insufficiency of the legal provisions in the cybercrime law and the difficulties encountered in applying it is article, specifically concerning penalties and circumstances that lead to the mitigation of sentences. The study proposed amending the relevant provisions in the cybercrime law to cover all forms of electronic begging outlined in other Jordanian laws, as well as newly emerging methods of soliciting funds online. Furthermore, the study emphasized the need for legislative clarity related to the penalties set forth across different laws and conditions that effect on sentencing.
