“The Role of Obligatory Benevolence in Humanitarian Relief for the Gaza Strip: A Foundational and Applied Study — The Post-October 7, 2023 War as a Case Study”

Abstract

This research presents a foundational study on the concept of obligatory benevolence in Islamic law and the associated legal duties that fall under its framework, considering it a core pillar of social solidarity and an effective means of addressing humanitarian crises. The study includes a practical application of this concept through humanitarian relief efforts targeting the besieged Gaza Strip following the war that began on October 7, 2023.

The paper examines the Islamic legal evidences affirming the obligatory nature of benevolence and highlights its role in supporting the Islamic socio-economic system. Furthermore, it discusses the catastrophic humanitarian conditions witnessed in Gaza, including widespread destruction, mass displacement, and total collapse of essential services—consequences expected to persist for years given the magnitude of devastation. These realities underscore the urgent need to activate authentic Islamic relief mechanisms, particularly those rooted in the paradigm of obligatory benevolence.

The research concludes that obligatory benevolence represents a sustainable strategic alternative to conventional humanitarian funding, especially in light of the international community’s failure to respond adequately. It recommends activating this framework through modern institutional mechanisms that align the objectives of Islamic law with contemporary humanitarian work.
