Specific and Partial Objectives of Al-Hanafi School: An Applied Study

Abstract

Objectives: The study aims to highlight the objectives of Sharia which related to the Chapters of jurisprudence, in addition to the partial objectives related to the branches of jurisprudence according to the jurists of the Hanafi School.

Methods: The study followed the descriptive approach based on induction, analysis and deduction, by inducting the books of Motoon and Al-Shrooh in the Hanafi school to extract the most prominent objectives mentioned in it, then analyze the expressions and justifications of the jurists of the school, in order to deduce the specific and partial objectives according to the Hanafi school.

Results: The study revealed the brilliance of Hanafi jurists in the jurisprudential justifications that leads to the legal objective; as the jurists of the school made the chapters of jurisprudence according to specific objectives to each chapter, so that the issues of the chapter revolve around this purpose and seek to achieve it, also they paid attention to the objective justification of the branches of jurisprudence, which in turn reveals the partial objectives of legislation.

Conclusions: The study recommends conducting more studies on objectives that highlight the Hanafi concern with the practical aspect of the objectives of Sharia, in order to reveal more objectives of legislation governed by the expressions of the predecessors.
