This study aims to determine the extent of compatibility between the provisions governing the incentive treatment in the Correction and Rehabilitation Centers Law and the provisions recently introduced by the legislator in the Jordanian penal legislation, most notably alternatives to custodial sentences and the enforcement judge. The study adopted the analytical approach and reached several key findings, including that the legislator vested the management of the correction and rehabilitation center with the authority to release a convict sentenced to imprisonment, regardless of its duration, prior to serving the full term, provided the convict exhibits good conduct. Conversely, the court has been vested with the authority to impose an alternative sentence to custodial sentences in accordance with specific controls. The study also put forth several recommendations, most notably the necessity of abolishing the incentive treatment as stipulated in the Correction and Rehabilitation Centers Law due to its inconsistency with the new provisions in the penal legislation.
