Any attack on the physical safety of individuals is a crime punishable by law. However, there are some exceptions to this rule, one of which is the right to self-defense. This right allows any person who is subjected to an attack on themselves, their property, their honor, or the person, property, or honor of another to use force in self-defense. This is permitted under Article 49 of the Qatari Penal Code, which grants a person the right to use violence and commit dangerous acts against others in self-defense. The legislator did not leave this right open-ended, but rather established legal controls for its use to prevent individuals from abusing their right to self-defense.
This research will attempt to shed light on the right to self-defense, considering it one of the important legal principles that most of the world's legislations have addressed. The researcher will explain the right to self-defense as stipulated in Qatari Penal Code No. 11 of 2004 and will compare the provisions of the Qatari Penal Code with those of the French Penal Code to examine any legislative shortcomings or deficiencies in the French and Qatari legal systems, in accordance with the established research plan.
