Abstract
The Legal Framework for Debt Insurance in Jordan
Abstract
This study examines the legal status of debt insurance contracts in Jordanian law, addressing the legislative gap and the jurisprudential debate over its characterization and distinction from suretyship (Kafala). The analysis concludes that debt insurance possesses an independent legal identity as a principal commutative contract, thereby excluding accessory defenses—such as the defense of exhaustion—from being invoked by the insurer. The study recommends legislative intervention to establish specialized rules for this contract.
