BASES OF THE RELATIONSHIP BETWEEN THE GOALS AND THE TEXTS

The goals of Islamic law (sharia) are the goals of the Holy Quran and Sunnah (tradition of the holy prophet) they were fetched out from their texts, it revolves around it, it cannot depart it, and an assumption of goals outside the texts is not permissible. However the fact that the goals were derived from the texts of the Quran and Sunnah; make the goals to guide to exegesis and understanding of the texts in a correct way. It is therefore compulsory to understand the partial texts in the light of the general goals. Understanding the texts in isolation from the goals is not permissible, likewise acting by the general goals in isolation from the texts, it is also compulsory to act according to the apparent meaning of the texts, the reasons and goals contained in them. With this, the relationship between the goals and the texts is definatly a relationship of concord and unity, as they both come from the same source, and it’s not possible to occur between them any contradiction.  However, in case of imagining or illusioning a contradiction, it’s definitely due to a mistake in understanding the texts, or that the goal is an illusory interest, in this situation, its therefore mandatory to consider the texts over the goals and the benefits that contradict the texts should be excluded, and it’s never permissible to consider the goals over the texts.

Therefore, based on the above mentioned, the relationship between the texts and the goals definitely centers on (3) bases: first: deriving the goals from the texts, second: being guided by the goals in exegesis or explanation of the texts, third: considering the texts over the goals when there is contradiction.

And an induction method shall be applied in this study and analytical or explanatory method for the bases of the relationship between the goals and the declarations with explanatory examples for it.

The research is aimed at actualizing numbers of results, most apparent of them are thus:

1-Explaining the connection and derivation of the goals from the texts of the Quran and Sunnah.

2- Exposing the roles of the goals in exegesis and understanding the texts in a correct way.

3- Emphasizing on the concord\unity and lack of contradiction between the goals and the texts.
