Abstract

 

the social security systems in various countries aim to provide individuals with protection againts the life risks they may encounter over the years. Therefore, the need arose to establish the concept of social security based on principles, rules, and regulations that enable workers to obtain their insurance rights fairly. This study addresses the problem of wage fluctuation , especially when there is manipulation by institutions regarding the data provided to the general social security institution. It also examines how the institution can detect whether there is manipulation or not through the procedures and criteria it adopts.

The study concludes that the social security institution has discretionary authority in estimating the wages of the insured individuals and settling their rights according to what it deems appropriate, especially in the absence of records that prove the accuracy of the data provided by the institution. This is in accordance with standards derived from administrative court decisions. Additionally , the institution has the right to oversee the decisions issued by its committees by allowing appeals against them.

The researcher also recommends the addition of provisions to the Jordanian social security law, clarifying the procedures followed to make decisions regarding the settlement of the rights of the insured individuals and the criteria adopted by the general social security institution in settling their insurance right. This is important to ensure a balance between the rights of both parties involved
