ABSTRACT
Most of the constitutions of Islamic countries stipulate that (Islam is the religion of the state), and legal authorities have differed in interpreting this article in to two paths : One of them is that what is meant by it is to inform about that Islam is the religion of the people only, and that the government is therefore not obligated in its laws to abide by Islamic law.
The second: informing about that Islam is the state’s law and public system, and that the government’s duty is therefore to adhere to Islamic law in its laws, and not to deviate from it.
In order to fill this defect, I dealt with the interpretation of this article according to the principles of islamic Jurisprudence linguistic rules, and I made an effort to reveal the principles of islamic Jurisprudence aspect in the connotations of its words in terms of their real and metaphorical meanings. Thus, my goal is to be achieved by determining its meaning and knowing the most correct interpretation of it.
