Abstract

The study aimed to highlight the civil protection of personal data from unlawful processing in accordance with Jordanian legislation through the recently issued Personal Data Protection Law, and comparing it with the European Union regulation, and the Egyptian Personal Data Protection Law, where the legislator tried to be familiar with all aspects of its legal protection, so he established mechanisms to protect Personal data from unlawful processing through the new law establishing the Personal Data Protection Council.

The researcher attempted, by relying on the comparative descriptive analytical approach, to explain the legal effects resulting from the processing through the rights and obligations of the parties to the processing process. The study showed the extent to which civil liability arises from the unlawful processing of personal data and the right of the injured party to fair compensation to redress the damage.

The researcher believes that the legal protection of personal data from unlawful processing will be sufficiently complete with the issuance of the regulations and instructions stipulated in the new law, to be within a legal framework that balances mechanisms for the rights of individuals to protect their personal data, and allowing the processing and retention of data in cyberspace.
