The rule of the imam's conduct over the parish is entrusted to the interest : Jordanian Traffic Law No. 18 of 2023 as a model: Applied rooting study
Abstract
AbstractThe study dealt in the first section with defining the rule of disposition of the subjects is subject to the interest and its legal basis. In the first section, he addressed the definition of the vocabulary of the rule in language and terminology in detail. Then, in the second section, he explained the legal evidence of the rule of disposition of the subjects is subject to the interest in both the Qur’an and the Sunnah of the Prophet, and among the companions of the Messenger of God. In the second section, the researcher focused on defining the traffic law, the causes and harms of traffic accidents, and how to reduce them. In the first section, he addressed the definition of the traffic law, its importance, and its legal objectives (preserving life and property). As for the second section, he studied traffic accidents in terms of their causes, harms, and how to reduce them. In the third section, he addressed and explained the applications of the rule to the amendments to the Jordanian Traffic Law No. (18) of 2023 and its legal basis in the third section, in terms of the amended articles in the Traffic Law related to preserving life and property and its legal basis, traffic violations and their legal basis, and organizing the traffic process and its legal basis. The study adopted the descriptive approach by extrapolating what was stated in the sources and references regarding the concept of the rule, its vocabulary, and areas of work with it, and used the analytical approach to analyze the legal and Sharia texts. The study came out with the most important results, which are that the guardian or his representative has the right to punish anyone who violates the established rules in a way that ensures the preservation of security and the consolidation of stability and interest by confiscating driving licenses or depriving him of them or arresting and imprisoning him. It concluded with recommendations, the most important of which is the need to highlight the impact of the rule that the imam’s behavior over the subjects is subject to the interest in the Jordanian Traffic Law and its amendments.
