ABSTRACT
This research aims to clarify the juristic status 0al-Karabisi within the Hanafi Islamic school of law by studying his endeavors as a jurist to derive and formulate legal rules (ijtihad). It examines the roles he fulfilled, such as legal derivation (istimbat), analytical jurisprudence and ruling derivation (takhrij), preference of one legal evidence over another (tarjih), discretion (tamyeez), and juridical affirmation (taqreer). The research also explores the level of ijtihad that Imam al-Karabisi achieved, employing inductive, analytical, and deductive methods to demonstrate his scholarly rank through examples that highlight the advanced juristic level he attained.
One of the key findings of this research is that Imam al-Karabisi, as determined by the researcher, is As'ad bin Muhammad bin al-Husayn al-Karabisi al-Hanafi, and he is considered one of the scholars of the late 5th century. It became evident that the claim of his death in the year 570 AH is incorrect, resulting from confusion with another individual. He is classified as one of the early jurists (mujtahids) within the Hanafi Islamic school according to the chronological classification, having reached the highest ranks of jurisprudence and ijtihad, earning the title of "Faqih al-Nafs" (a jurist of profound understanding). Additionally, he is regarded as one of the pioneers of the science of legal distinctions (furuq), through his famous book, Al-Furuq, which is considered one of the most important and comprehensive works in this field.
