Abstract

The study includes the rules governing jurisdiction in the Law of Sharia Court Procedures No. (31) of 1959 and its amendments, and the Civil Procedure Law No. (24) of 1988 and its amendments, in order to determine the existence of value jurisdiction in both courts, with an explanation of the consequences of violating the rules of value jurisdiction before the Sharia and civil courts.
The study finds Many  recommendations, that value jurisdiction does not exist in first instance courts in the Sharia judiciary, whereas we find it legally framed in first instance courts in the regular judiciary system. With regard to second instance courts, the existence of value jurisdiction is indirect and restricted by law in both jurisdictions.
The researcher recommends restructuring Sharia courts to expand their functional scope, adopting additional levels of litigation for complex and multifaceted cases, and unifying the procedural rules for judicial jurisdiction in both Sharia and regular courts.
